We represent individuals who have been denied pension, health or disability benefits under plans governed by the Employee Retirement Income Security Act of 1974 (“ERISA”). We also represent classes of beneficiaries in lawsuits against ERISA plans and fiduciaries that have breached their duty and failed to pay benefits. One of our partners is the author of a section in a desk book on ERISA issues, a frequent speaker at continuing education classes for other attorneys and a speaker before community groups on ERISA issues.
Our representation of individuals in ERISA actions is not limited to benefit claims. We have successfully represented beneficiaries in complex QDRO disputes under ERISA. See Hamilton v. Washington State Plumbing & Pipefitting Industry Pension Plan, 433 F.3d 1091 (9th Cir. 2006). We have successfully litigated ERISA preemption issues. See Washington Physicians Service Ass’n v. Gregoire, 147 F.3d 1039 (9th Cir. 1998)
