November 20, 2017 Update: Checks for approved claims will be mailed within the next two weeks. Class members who appealed a partial denial of claims will receive a check reflecting the approved amount while the appeal is pending. If the class member’s appeal is successful, an additional payment will be issued. The Claims Administrator has indicated that all approved claims will be paid at treble the approved amount.
Update: The settlement described below has been formally approved by the court, and is now in place.

Welcome to the Lopez class action information page. In this lawsuit, Ms. Lopez alleged that Yakima Regional Medical Center and Toppenish Community Hospital (together, “the Hospitals”) did not screen patients for charity care before seeking payment for hospital services those patients received. After extensive litigation, the Court certified a class and then held that the Hospitals violated the law by not properly screening patients for charity care. After these holdings, the case settled for $4.5 million, subject to court approval.

January 18, 2017 Update: The Court has issued preliminary approval to a $4.5 million settlement, and notice of the settlement is being mailed to potential class members. Radio and published notice is also underway.
