Motion for Attorney Fees/Costs/Inventive Awards Filed

Class counsel has filed a motion for attorney fees, costs, and incentive awards to class representatives. Here are the documents filed on February 18, 2026: (1) Class counsel’s Motion for Attorneys’ fees, etc.; (2) Declaration of Ele Hamburger in Support; and (3) Proposed Order. Class members have the right to comment on, or object to, the requests made in the motion by class counsel. Please see the instructions in section six of the notice posted here for details on how to submit comments or objections. The deadline to do so is March 6, 2026.

In E.S. et al., v. Regence Blueshield, No. 2-17-cv-1609, the parties have reached a settlement agreement which Federal District Court Judge Richard A. Jones has preliminarily approved.

Under the Agreement, Regence Blueshield will pay $3,000,000 to a settlement fund to reimburse class members who submit claims for uncovered expenses for hearing aids and associated services incurred between October 30, 2014, and December 31, 2025.
